Fat Wallet moved their entire business out of Illinois when that state passed an affiliate nexus tax. I know a number of affiliates who relocated their businesses from CA to NV after the California tax went into effect.

All of the CA provision is specific to CA residents conducting sales to other CA residents. As I understand it, the solicitation comes into play in scenarios where you have specifically targeted individuals (email being the most obvious example of this) with a direct link to the merchant site in the email. Sending people back to a landing page owned by the CA resident appears to be acceptable.

Or is that not the case unless you are directing it to CA residents?

Ex. You setup a company like Name Here Advertising Solutions and get paid as an employee or share holder in the business. I’m fairly certain doing it this way while a bit dodgy is a safe way to pass the money back to you.
